Terms & Conditions of the SIS Soccer Shop

§ 1 Scope and Right to Make Changes

(1) The SIS Soccer Shop (hereinafter referred to as "the Shop") conducts all business exclusively on the basis of the Terms & Conditions (T&C) currently in force. You can access the latest version by clicking on "Terms and Conditions" on each page of the Shop's website.

(2) The Shop reserves the right to change its T&C. In the absence of other provisions, these changes become effective as of their publication on the website.


§ 2 Buyer's Right of Cancellation

(1) The buyer may cancel his or her order within fourteen (14) days (for customers from GB: 30 days) of placing their order, no reason necessary. The buyer can do so by letter, fax, e-mail or any other durable medium. To be considered valid, cancellations must be postmarked before the end of the fourteen (14) day period (for customers from GB: 30 day period). The right of cancellation does not apply to DVDs, if the DVDs have already been shipped (for customers from GB: cancellation does also apply to DVDs).

(2) Any product already shipped within the fourteen (14) day cancellation period (for customers from GB: 30 day cancellation period) must be returned with the proper paid postage by the buyer. The product should be sent by the same shipping method the Shop originally used to ship the product to the buyer. The buyer is liable for all shipping costs associated with the return of the product, including those extra shipping costs that may arise as a result of using a different shipping method.

Upon receipt of returned goods, the Shop will immediately refund the buyer's purchase price less the shipping costs. For partial cancellations, the Shop will calculate the ratio of the value of goods returned to that of goods kept and refund the same proportion of the shipping costs.

(3) The Shop will not accept unpaid returns. The Shop expressly reserves the right to hold the buyer responsible for any (additional) costs related to the unpaid shipment.

(4) If returned goods are significantly damaged, and the buyer is responsible for the damage, the Shop reserves the right to charge for replacement. This applies equally to goods that have been used (e.g. a book that has been read) before being returned.


§ 3 Buyer's Right of Product Return

(1) The buyer may return his or her order within fourteen (14) days (for customers from GB: 30 days) of the shipping date of their order, unless DVDs have been opened, books have been read, or software product codes have been released. To be considered valid, returns must be postmarked before the end of the fourteen (14) day period (for customers from GB: 30 day period). Returning the goods to the Shop (complete address available at the end of this T&C) must be shipped within fourteen (14) days (for customers from GB: 30 days) to be eligible for a product refund. The right of product return does not apply to DVDs (for customers from GB: also DVDs can be returned).

(2) Returns require proper postage; they should be sent by the same shipping method the Shop originally used to send them to the buyer. The buyer is liable for all shipping costs associated with the return of the product, including those extra shipping costs that may arise as a result of using a different shipping method.

§ 4 Delivery, Shipping Costs, Import Taxes

(1) Every shipment is sent as quickly as possible. However, shipments may be delayed past any dates that may be given on the website, particularly in the case of goods for which the Shop depends on another distributor or an event outside of the Shop's control that causes shipping delays (e.g. union strike). In the event of unusual delays, the Shop will inform the buyer as soon as these delays can be estimated.

(2) The Shop is always authorized to make partial shipments. Shipping costs for back orders are the responsibility of the Shop.

(3) Shipping costs are calculated in addition to all other costs. Specific information is available on each of the Shop's website under “Shipping Information.” Generally, shipments are sent via the postal service. Customers of the US Shop (North and South America) may, upon written request, receive shipments by other methods at an additional cost to the buyer.

(4) Any import taxes or tariffs imposed by individual nations are the sole responsibility of the buyer.


§ 5 Conditions of Payment

(1) The purchase price is to be paid in full before goods are shipped.

(2) Payments may, upon receipt of the preliminary bill, be made by credit card (Visa, MasterCard, and Euro card).

(3) The Shop will not accept any requests for adjustments or reductions unless it has determined them to be legally valid and delivered to the Shop in written communication only.

(4) The currency for all agreements and transactions is: US$ for North, Central and South America, as well as the Caribbean; UK£ for Great Britain; and EURO for all other countries.


§ 6 Guarantees and Liability

(1) In the event that goods delivered have defects for which the Shop is responsible, the Shop will remedy the defects or provide a replacement within an appropriate time period. Failing this, the buyer has the right to cancel the purchase or demand a reduction in the purchase price.

(2) With regard to damages for which the Shop is responsible, the Shop assumes liability for significant violation of contract and/or absence of advertised features. Moreover, the Shop will only assume liability—regardless of legal basis—for damage resulting from gross negligence on the part of the Shop or its' agents. The Shop only assumes liability for damages equal to the cost of such said product. The buyer accepts such liability term upon placement of their order.


§ 7 Data Protection and Encryption

(1) The buyer expressly agrees to allow the Shop to store, process and use all personal data entered during the ordering process, for contractual purposes only. Customer data will not be passed on to third parties.

(2) The Shop ensures that the entire ordering process (particularly the transmission of payment information such as credit card numbers) will be transmitted from the buyer's computer to the Shop's server in encrypted form only, through the use of appropriate software (currently SSL).


§ 8 Miscellaneous

(1) Applicable law—excluding UN commerce law—is as follows: For Germany, German law; for Great Britain, British law; and for North, Central and South America, as well as the Caribbean, US law. The legal venue for any disputes arising under these terms and conditions is Muenster, Westphalia, Germany.

(2) Changes to this T&C must be made in writing only. The buyer cannot rely upon any verbal representation made by any employee of the Shop. Invalidation of any individual provisions does not invalidate the T&C as a whole, nor does it invalidate any contracts made on the basis of the T&C.
